Settlement Information

A proposed Settlement has been reached in a class action lawsuit in a case titled Jammeh v. HNN Assoc., LLC, Gateway, LLC, Columbia Debt Recovery, LLC d/b/a Genesis Credit Management, LLC, and William Wojdak, U.S. District Court for the Western District of Washington, Case No. 2:19-cv-00620-JLR.

The Plaintiffs allege that HNN Associates, Columbia Debt Recovery, and William Wojdak violated the federal Fair Debt Collection Practices Act, Washington Collection Agency Act, Washington Consumer Protection Act, and Residential Landlord-Tenant Act by keeping security deposits and miscalculating interest on alleged debts. Defendants deny they did anything wrong. The Court has not decided who is right. To resolve this lawsuit Defendants have agreed to pay $1.6 million into a Settlement Fund, which will be used to pay awards to Class Members, service awards to the Class Representatives (up to $12,000), attorneys’ fees and costs (up to $600,000), and settlement administration costs (estimated at $27,067).

Who Is A Class Member?

You may be in the HNN Classes if you moved into a rental property managed by HNN Associates, LLC, in Washington, before February 1, 2019; moved out on or after July 12, 2017 and you: (1) paid a security deposit without receiving a complete move-in checklist; or (2) HNN kept your security deposit after sending you a statement for the move-out charges more than 21-days after you moved out; or (3) you moved in to an HNN managed property after July 31, 2016 and your deposit was forfeited by HNN. You may be in the CDR Class if HNN placed your account in collections with CDR between February 13, 2017 and January 31, 2019, and CDR sent at least one written collection demand to you. You may be in the CDR FDCPA Subclass if CDR sent at least one written collection demand to you on or after July 12, 2018.

By doing nothing, you keep the possibility of getting money or benefits that come from the settlement, but you give up any rights to sue HNN, apartment complexes HNN manages, Columbia Debt Recovery, Genesis Credit Management, or William Wojdak separately about the same or similar legal claims made in this lawsuit. You do not have to file a claim to receive payment. If you shared an apartment with other adults, the settlement check will be mailed to the person listed as the primary tenant in HNN’s records. If the settlement is approved, you will be bound by the Settlement Agreement, and you give up the rights to sue HNN, apartment complexes HNN manages, Columbia Debt Recovery, Genesis Credit Management, or William Wojdak separately about the same or similar legal claims in this lawsuit, but you will still be eligible to receive money and benefits that come from the settlement.
